Handling of personal data

The data is processed exclusively by the employees of the Office for Training Funding (BAföG Office) or the counseling service.

The data collected will be permanently deleted immediately in the event of the consultation appointment being canceled. After the consultation, the collected data is kept for 7 days in case of queries and then automatically and permanently deleted.

refering to Art. 13 Para. 1 a) and b):
The authority responsible for collecting the data in the context of applying for training grants under the Bundesausbildugsförderungsgesetz (BAföG) is the BAföG-Amt responsible for the trainee. It is responsible within the meaning of Article 13 of the General Data Protection Regulation. The contact details of the data protection officer responsible for the Studentenwerk Halle -BAföG-Amt - are provided later on this page.

refering to Art. 13 Paragraph 1 c):
The collection of personal data is necessary in order to be able to decide on the application for funding under BAföG (§ 46 Paragraph 3 BAföG in conjunction with § 60 First Book of the Social Code).

  • The information on the applicant's assets provided in the context of the application can be obtained through a data comparison (Section 41 Paragraph 4 BAföG in conjunction with Section 45d EStG) and an account query in accordance with Section 93 Paragraph 8 Tax Code (AO) at the Federal Central Office for taxes, if the conditions for this are met. 
  • The loans provided, including the associated personal data, are transmitted to the Federal Office of Administration by the BAföG-Ämter for the purpose of collecting the loan. 
  • In the event that training grants are used in the form of an interest-bearing bank loan from the Kreditanstalt für Wiederaufbau (KfW), the data required for loan repayment are exchanged between KfW and the Federal Office of Administration (BVA). KfW transmits the payment data to the responsible BAföG-Amt

The personal data will be stored at the BAföG-Amt of the Studentenwerk Halle for the duration of the BAföG and - due to the necessary verifiability of the loan amounts paid - regularly for a period of 6 years after the expiry of the last individually determined Maximum funding period saved. Notes on data protection for BAföG forms 1, 3, 4, 6, 7 and 8

In the following, we will inform you in accordance with the EU General Data Protection Regulation (GDPR) about the manner and background of the processing of your personal data in connection with your application for funding through the Bundesausbildungsförderungsgesetz (BAföG).

The following information applies equally to applicants under BAföG as well as to persons obliged to provide information such as spouses, life partners and parents within the framework of the implementation of the law.

We will provide you with the following information in accordance with Art. 13 and 14 GDPR when collecting personal data:

1. Information on the collection of personal data

  • The authority responsible for collecting the data in the context of the application for training grants under the Bundesausbildungsförderungsgesetz (BAföG) is the authority at which the office responsible for training assistance for the trainee was established. She is responsible within the meaning of Art. 13 GDPR. The contact details of the person responsible and the responsible data protection officer can be found in the notification from the BAföG-Amt.
  • The collection of your personal data is necessary in order to be able to decide on the application for funding under the BAföG (Art. 6 Paragraph 1 lit. e GDPR in conjunction with Section 46 Paragraph 3 BAföG in conjunction with Section 60 first Book of the Social Code).

2. Information on further processing and transmission of personal data

Insofar as this is necessary in each case, your personal data can be further processed as follows and transmitted to other competent bodies:

  • The information on your income and the income of your spouse or life partner and, if applicable, the income of your parents provided in the context of the application can be obtained from the relevant social security service provider, the tax office and the respective employer, as well as through an account query in accordance with Section 93 Paragraph 8 of the Tax Code (AO) at the Federal Central Tax Office.
  • The information on your assets provided in the application can be checked by means of a data comparison (§ 41 Paragraph 4 BAföG in conjunction with § 45d EStG) and an account query in accordance with § 93 Paragraph 8 Tax Code (AO) at the Federal Central Tax Office if the requirements for this are met.
  • The loans provided, including the associated personal data, are sent to the Federal Administration Office (BVA) by the offices for training funding for the purpose of loan collection (Section 9 Loans Ordinance in conjunction with Section 18 (6) and Section 39 (2) BAföG).
  • If training grants are used in the form of an interest-bearing bank loan from the Kreditanstalt für Wiederaufbau (KfW) in accordance with § 18c BAföG, the responsible office for training grants transmits the payment data to KfW (§ 41 (2) BAföG). The data required for loan repayment are exchanged between KfW and the Federal Office of Administration (BVA) (Section 18c (7) BAföG).
  • Your data, in particular your address data or account information, will be passed on to the responsible state treasury for cash processing of the services (e.g. payment of funds) and from this to credit institutions (e.g. account-keeping bank of the trainee) (state data protection laws).
  • In the event of an unsettled claim against you, your personal data will be passed on to the enforcement authorities responsible in the respective federal states, e.g. the tax office of your residence, in accordance with the respective state enforcement laws. This is possible if, for example, you have received an overpayment that is reclaimed by the Office for Education Claims but you do not pay.
  • In order to exercise technical and legal supervision by the relevant state authorities, your data can be passed on to these authorities by the responsible office for training funding (state data protection laws). This also applies in the case of audits by the respective state or federal audit office (state budget regulations, federal budget regulations).
  • The data on the receipt of the health and long-term care insurance surcharge are passed on to the Central Allowance Office for Retirement Assets of the German Pension Insurance (ZfA) as part of the notification procedure according to Section 10 (4b) EStG.
  • As part of the BAföG application processing, pension offices can also be questioned about income and your data can be passed on to the responsible job center/to the responsible employment agency (ARGE) (Section 47 (5) BAföG).
  • The information on the income of a parent, spouse or partner of applicants is given to the trainee in the approval notification (BAföG notification). Parents, spouses or life partners of the trainee can object to this data being passed on to the trainee, with the exception of the amount of the offset income, stating reasons (Section 50 (2) sentence 3 BAföG).

3. Information about the storage of your data

Your data will be stored by the respective authority after it has been collected and, if necessary, forwarded for as long as this is necessary for the respective task in compliance with the statutory retention requirements of the federal and state governments. The storage period can then be up to 12 years after the last repayment of the BAföG loan portion before the data is finally deleted.

4. Information about your rights and obligations

  • You have a right to information about the personal data concerning you and, if necessary, to correction, deletion or restriction of the processing of this data and a right to object to the processing as well as a possible right to data portability vis-à-vis the Office for Training Support.
  • You have the right to lodge a complaint with the responsible data protection supervisory authority. Your BAföG-Amt will provide you with more information.
  • If you do not want to provide the necessary information, the entitlement to BAföG cannot be checked. As a result, no final decision will be made on the application and, as a result, no funding under the BAföG can be made.

Data protection information on student accommodation/dormitories

Online dorm application

  • Information on the desired dormitory: location, preferred dormitory (s), university affiliation and preferred moving-in date
  • Personal data of the applicant: first name, surname, maiden nameª, date of birth, marital status, name of the spouseª, number of children living with themª, nationality, e-mail address and any physical disabilityª.
  • Information on the course: department, program and number of semesters on the date you want to move in
  • Home address: Street, house number, zip code, city, country, telephone numberª and mobile phone number.
  • Current semester addressª: street, house number, zip code, city, country, telephone numberª
  • Documents for legitimation and identity verification: Certificate of matriculationª, photo, passport or ID copy
  • Other informationª: Free text 

Communication with the student housing department is usually carried out by email. The sending of the e-mails, ie the transport from the e-mail server of the Studentenwerk Halle to the destination e-mail server, is encrypted (TLS; STARTTLS). The content of the emails is not encrypted, ie there is no end-to-end encryption. If this type of communication with the Studentenwerk Halle is not desired, the applicant will be sent a conventional application form by post after consultation over the phone.

The data is processed exclusively in the student housing department in the university catering / housing department (department and department management, accommodation agency and property management) and in accounting, internal services department.

Legend: ª marks voluntary entries. All other data are mandatory data, without which an online application cannot be carried out.

We use online conference tools for communication with our customers. The individual tools we use are listed below. If you communicate with us via video or audio conference via the Internet, your personal data will be recorded and processed by us and the provider of the respective conference tool.
